我国海商法有关海运提单强制适用问题的研究

确认海运提单法律适用是一项比较复杂的问题,涉及到多层面的法律适用问题。不同的层面有时交融在一起,又为确认海运提单法律适用带来一定的难度和困惑。究竟以何种法律解决不同层面的问题,不但给当事人带来困惑,而且为法官审案造成极大不方便。我国海商法立法上没有明文规定我国海商法强制适用范围,理论和司法实务中引发了我国海商法是否对进出我国港口货物签发的海运提单具有强制适用以及根据提单法律适用条款引用的外国法违反了我国海商法第四十四条的强制性规定,是否给予确认的争论。为根本解决提单法律适用问题,本文提出我国海商法应规定其强制适用范围。

Study on the Mandatory Application of CMC Relating to Ocean Bills of Lading

It is rather complex issue for confirmation of applicable law on ocean bill of lading as involving multi-level application of the law.Different levels sometimes blending together bring a certain degree of difficulty and confusion for recognizing the applicable law on the ocean bill of lading.With what law to solve the different levels problem,cause confusion not only for the parties but also caused great inconvenience for the judges.China's legislation does not specifically require the mandatory application on ocean bills of lading,theoretical and judicial practice in China triggered symposium on whether CMC is mandatory application on ocean bills of lading in and out of China's ports as well as the selected foreign laws in accordance with applicable provisions of the bill of lading in violation of Article 44 of CMC enforcement provisions whether to grant recognition to the controversy.In order to solve the problem totally,this paper presenting the views that our CMC should provide its mandatory application.
