民事证据法中确立诚实信用原则的探讨

诚实信用原则作为现代民法最重要的基本原则,被我国民法学界称为“帝王条款”。然而诚实信用原则能否作为民事证据法的一项基本原则是一个值得探讨的新课题。本文以诚实信用原则的本质为出发点,就民事证据法中确立诚实信用原则为基本原则的必要性进行了论证,进而论述了诚实信用原则作为未来民事证据法的基本原则,对整个民事证据法立法及其解释适用的指导意义,以期对完善我国的民事证据立法有所裨益。
