晚清《行政裁判院官制草案》的意义与影响

本文以中国历史上第一部关于行政诉讼制度的法律《行政裁判院官制草案》为对象，着重研究其产生的原因、基本特点及历史地位。本文认为，《行政裁判院官制草案》的诞生是西方宪政思想传播和清末立宪思潮兴起的结果，标志着中国社会权力分立与制衡思想的启蒙和现代权利意识的觉醒，对中国北洋政府、南京国民政府的行政诉讼制度产生了重大影响，具有重要的历史意义。

Significance and Impact of Late Qing Dynasty's Protocol of Administrative Litigation's Bureaucrat System

This paper focuses on the first law related to the administrative litigation system in China's history,i.e.Protocol of Administrative Litigation's Bureaucrat System and explores the background,basic features and historical status of the law.The birth of Protocol of Administrative Litigation's Bureaucrat System in late Qing Dynasty was the result of the spread of western constitution in China and the emergence of constitutionalism thoughts in late Qing Dynasty.It indicated the initiation of power schism,balance and the arousal of modern droit consciousness in Chinese society.It had had a great influence on the administrative litigation system of Bei Yang government and Nanjing government,and had historical significance.
