论刑事审判监督程序的现代转型

我国现行的刑事审判监督程序深受传统文化和司法理念的影响，在价值理念和基本制度架构上，均存在着背离现代刑事诉讼理念之处，如价值理念错位、人权保障理念缺位、程序结构异化，等等。与我国现行刑事诉讼制度的发展同步，刑事审判监督程序也面临着由传统向现代转型的艰巨使命。当前，《刑事诉讼法》修改在即，刑事审判监督程序改革成败与否的关节点就在于能否通过现代型刑事诉讼理念的引入，实现刑事审判监督程序的现代转型。

On the Modern Approach of Criminal Supervision Proceeding

Under the influence of traditional culture and traditional notions of justice, the current procedure for trial supervision in China flies in the face of the notions of modern criminal procedures in terms of values and institutional structure. For instance, it lacks the correct value orientation, it doesn't cater for the protection of human rights and its process framework has dissimilated. With the development of the Chinese criminal procedure, the current procedure for trial supervision in China has to shed the traditional outfit and be modernized. To facilitate the reform of the supervision procedure, in amending the Criminal Procedural Law, modern concepts of criminal procedure must be introduced.
