浅析电子商务合同的法律问题

电子商务合同是随着计算机和互联网技术的发展与应用而产生的一种全新合同形式。近年来随着网络的发展,电子商务获得了前所未有的发展。然而立法却远远滞后于这一新型的商务运作方式。文章针对电子商务的发展对我国传统合同制度所产生的影响,从我国现行法律的具体规定出发,对电子商务中合同的订立、合同成立的时间和地点,以及消费者权益的保护作了法律上的探讨,并对完善我国的相关法律规定提出了粗浅的建议。

On Several Legal Problems of Electronic Commerce Contracts

With the development and application of the computer techniques and Internet, electronic commerce contract has become a new form of contract. In recent years, with the development of the network, the electronic commerce has acquired unprecedented development. However, the lawmaking has developed far behind this new business operation model. As a result, a series of theoretical and practical arguments have appeared to be solved urgently. Since the current electronic commerce contract is different from the traditional one in many ways,this article makes some discussion on the time and place of the establishment of contract and the protection of the consumer rights in electronic commerce.
