| 摘 要： | 当前环境保护出现了“刑罚化”的趋势，国外有关环境刑法理论日益丰富。本文简要介绍了日本环境刑法的发展情况，并着重评述日本环境刑法理论之新近动态，特别考察了日本环境刑法理论中的保护法益、构成要件及企业法人犯罪等内容。

| Abstract: | Presently, the tendency of "Criminal Punishment" has arisen in the field of environmental protection, which increasingly enrich the theory abroad concerning environmental criminal law. This paper introduces the recent development of Japan's environmental criminal law legislation and research. The paper also investigates some important points of the theory of Japanese environmental criminal law in environment protection, such as legal interests, component parts and corporate crime, etc.. |
