| 摘 要： | DRB作为ADR（替代式纠纷解决方式）的一种，在工程界越来越得到重视和推广。FIDIC合同条件，被誉为“国际土木工程的圣经”，在1996年引进DRB的基础上，于1999年正式形成完整、系统的DAB规则。文章以FIDIC彩虹系列中的红皮书《施工合同条件》为例，对DAB规则进行简要归纳总结。分析DAB的调解性和准仲裁性，有助于了解DAB的本质，从而更好地运用DAB的调解手段来解决争议。

| Abstract: | DRB （Dispute Review Board）, as one way of ADR （Alternative Dispute Resolution） , has being extensively highlighted and promoted in the civil engineering field. DRB was firstly introduced into FIDIC Contract Conditions ＂the Bible for international civil works＂ in 1996 and based on which, a set of systematic and integrated DAB （Dispute Adjudication Board） rules was formulated by FIDIC in 1999. The arbitration and mediation nature of DAB can be well understood by analyzing the DAB rules stipulated in Conditions of Contract for Construction （＂red book＂） of FIDIC Rainbow Series. Better understanding the nature of DAB will be helpful in application of DAB to solve related disputes during implementation of a contract. |
