| 摘 要： | 根据国际海事委员会(CMI)运输法最终框架文件草案中控制权条款的规定,分析海上运输中货物控制权的概念、性质及行使等内容,对海运货物的控制权有关问题予以探讨。在此基础上,结合我国现行法律,充分借鉴控制权概念,针对我国《海商法》关于控制权概念的空白,对《海商法》的修改和完善提出相应的立法建议。

The Research upon the Right of Control on Goods Carried by Sea |

| Abstract: | This paper, referring to the provisions of the right of control in CMI Draft Instrument on Transport Law, analyzes the concept, the property and the exercise of the right. Based on the above, linking the current law of China and with the reference of the concept of the right, some suggestions of amending and perfecting the provisions of the relevant right in CMC are given as well. |
