对《建筑法》修订若干问题的探讨

在颁行8年之后,《建筑法》与建筑市场管理、其他建设法规已不能很好地协调,存在诸如调整范围过于狭窄、工程保证担保规定缺乏、肢解分包规定不合理等问题。基于此,国家有关部门已启动《建筑法》的修订工作。本文分析了《建筑法》的不足,将修改内容分为全法的结构性修改和条文的根本性修改,并对于具体修改方案提出了建议。

Discussions on Relevant Issues on Revision of Construction Law

After eight years of its enactment, the Construction Law cannot well match the administration of the construction market and coordinate with other construction codes and regulations. There exist such problems as too limited scope of application, lack of clauses regarding construction surety and bond and unreasonable clauses on division of subcontracts. As a result, relevant departments concerned of the state have initiated the revision of the Construction Law. This paper makes an analysis of the shortcomings of the Construction Law. The modification is further divided into structural modification of the whole law and item amendment based on significance and extent. The paper also presents recommendations for a detailed modification programme.
