罢工权的法理透析

摘    要:随着罢工事件的不断发生,罢工权开始日益受到社会的关注和重视。罢工主要是市场经济条件下贯彻利益最大化原则过程中,劳资矛盾未能得到及时解决而形成的劳动者的一种表达利益诉求的经济手段。罢工权并不等于罢工,确立罢工权并不必然导致罢工现象的发生。深入分析罢工权的权利属性,认为罢工权属于公民基本权中的劳动权,因此罢工权应当是公民的一项基本权利,但为避免权利滥用需要对罢工权进行法律上的限制。

Abstract:With strikes taking place constantly,the right to strike has drawn the social concern and attention.Strike,an economic instrument for the workers to express their interest and demands, mainly occurs in the market economy conditions and the process of implementing the principle of maximizing interests when the labor-management conflicts can not be resolved in time. The right to strike does not mean going on strike, and establishing the right to strike does not necessarily lead to the phenomenon of strikes. By analyzing the properties of the right to strike, the paper shows that the right to strike should be a fundamental labor right of citizens. However, legal restrictions are needed to avoid the abuse of the rightS.
