| 摘 要： | 《汉堡规则》第一次在国际范围内明确规定了实际承运人制度,我国《海商法》借鉴《汉堡规则》对此制度的规定,制定了我国的海上货物运输中的实际承运人制度。本文试图从实际承运人法律制度的确立,实际承运人制度的概念,责任性质和范围等方面对这一制度作以阐述,并对不完善之处提出建议。
