甘肃农业循环经济立法现状及其完善

国家将甘肃作为首个省级循环经济示范区给予重点支持,研究甘肃农业循环经济地方立法制度具有重要的理论和现实意义。通过对已颁布实施的甘肃涉农法规政策进行梳理,总结了我省在农业循环经济地方立法方面取得的成就,也指出立法滞后和已有法规不完善等问题,提出应在国家层面立法体系不断完善的基础上构建我省农业循环经济立法体系;从权利义务分配、政府责任、制度细化等方面完善进现有法规的不足。

The present situation of Gansu agricultural circular economy legislation and its perfect

Countries puts Gansu as the first provincial recycling economy demonstration areas and gives the key support,so studying the Gansu agricultural circulation economy system of local leg-islation has important theoretical and realistic significance.In this paper,By analyzing the related laws and regulations have been promulgated and implemented the policy of Gansu,We summarize the local legislation in agricultural circular economy in our province＇s achievements.We also point out the problems of the existing legislation lags behind and incomplete regulations and propose that we should construct the Gansu Province Agricultural Circular Economy Legislation System which based on national legislation system continuous improvement;Moreover,We indicate that we can from the distribution of rights and obligations,the government responsibility,the system elaboration and so on to perfect the shortage of the existing regulations.
