民营企业生存权的宪法保障路径--兼论我国宪法相关规定的完善

民营经济的合法性、市场经济体制、公民私有财产权和经济自由构成了确认和保障民营企业生存权的四条路径，只有当宪法对此四者同时作出规定时，民营企业的生存权才能得到完全的确认和有效的保障。改革开放以来，我国宪法经过四次修改，在民营企业生存权保障方面取得了重大进展，但是也存在着明显的不足。

On Constitutional Protection of Existence Right of Private Enterprises--And Perfection of Related Rules in Our Constitutions

The legality of the private economy, market economy, private property right, and economic freedom constitute the four ways of confirming and protecting the existence right of private enterprises. Only when the constitution regulates the above four approaches,can the existence right of private enterprises be fully confirmed and effectively protected. Our constitution has made great progress in this aspect by virtue of four amendments since the reform and opening-up, but it still has many shortcomings.
