| 摘 要： | 海上保险人以自己名义对第三人进行代位求偿权诉讼,使得第三人就同一保险事故对被保险人的反索赔权行使困难,可能造成司法程序上的混乱。针对此现象加以分析,试图寻找解决问题的方案。

A Procedure Issue of Marine Insurer's Subrogation -the Third Party's Counter Claim |

| Abstract: | The marine insurer himself applies the subrogation procedure against the third party, which makes the third party being difficult to apply the counter claim against the insured party, and this may bring dilemmas to the jurisdiction. Then this article analyzes the situation and tries to find precept dealing with the issue. |
