在国际货运代理实务中,国际货运代理人有时以委托人的名义为委托人办理和提供货物运输服务,有时以自己的名义为委托人办理和提供货物运输服务,有时以当事人的身份为委托人提供货物运输服务。货代以不同的角色和身份办理货物运输服务时,经常会涉及运费的支付问题,这往往涉及到承运人、国际货运代理人、托运人和收货人等有关方的利益。货代公司为了在激烈的竞争中生存,保住货源和客户,常为客户垫付运费,并承担着巨大的风险,货代公司是否应当支付运费,是否能够追偿运费,对货代公司而言是非常重要的。

On the Issue of Freight Payment by International Freight Forwarder in Practice

In international freight forwarding practice,the payment of freight involved the interests of carrier,forwarder,shipper and consignee etc.Under the contract of carriage of goods by sea,the shipper or consignee has the duty to pay the transport freight.Whether the forwarder has the duty to pay the freight or has the right to be compensated by the shipper or consignee depend on the forwarder's identity.If the forwarder supplies the service by using the name of his principal,he has no duty to pay the freight.If the forwarder supplies the service by using the name of himself,he has duty to pay the freight.
