论我国行政复议机构的重构

我国现行行政复议机构分散林立,没有独立的法律地位,在实践中不能独立、公正、有效的审理行政复议案件,从而使行政复议制度形同虚设,因此必须调整思路予以重构。应借鉴有关国家和地区的行政复议制度,统一、独立设置我国的行政复议机构;同时在队伍建设上借鉴仲裁员制度,这样既可发挥行政复议制度的应有作用,又可克服机构臃肿的弊端。

On the Reconstruction of the Administration Reconsideration Organization in Our Country

The administration reconsideration organizations in our country are in a deconcentrated situation,lack of independent legal status,and can not judge the administrative reconsideration cases independently,justly and effectively,which makes the administration reconsideration system nominal.Accordingly,we should update our idea to study the relating systems in the foreign countries and reconstruct ours,that is,to set up the administration reconsideration organizations unitedly and independently.At the same time,in the aspect of personnel requirement, the arbitrator system can be used for reference.Thus the functions of the administration reconsideration system can be maximized and the overstaffed situation can be solved.
