关于国际货运代理企业扣留提单问题的探讨

最高人民法院新的司法解释《关于审理海上货运代理纠纷案件若干问题的规定》（以下简称“规定”）已于2012年5月1日起正式开始实施.该“规定”主要调整货运代理企业接受委托办理与海上货物运输有关的货运代理事务时与委托人之间形成的权利义务关系.在货运实践中,货运代理企业常常以拒绝交付提单等运输单证作为促使委托人支付相关费用的先决条件,产生了很多纠纷.在新的“规定”中对于货运代理企业扣留提单等单证问题,最高人民法院给予了新的解释,对国际货运代理企业的行为进行了重新的定义和规范.
