| 摘 要： | 高校与在校大学生之间的法律关系的理论争议,莫衷一是。在评析各种学说的基础上,定位为教育契约关系,更好地突出和展现学校与学生之间的权利义务关系,梳理学校的义务和责任,在新形势下逐渐弱化学校的行政管理法律关系,在此基础上,明确在校大学生权利和利益的具体体现,使在校学生更好地保护自己的权益。

| Abstract: | There are various theoretical controversies of the legal relationship between universities and college students Based on analyses of all the concepts, the author believes that the contractual education relationship may highlight and demonstrate the relationship between the rights and obligations for universities and students, and clear the duties and responsibilities of universities. In the new situation, administrative legal relationship should be weaken to clarify the interests and rights of the college students and enable them to protect their own interests. |
