| 摘 要： | 我国新的《破产法》已经出台,但是在金融机构破产这一问题上刻意留下了一道口子。这是因为金融机构破产具有不同于一般企业的特殊之处。本文从金融机构破产的含义、特殊性及必要性着手进行探讨,最后提出了加强金融机构破产法律监管的几条措施。
