论海上交通信息数字化共享的法律困境

海上交通信息作为人类智慧成果的一种,在我国正高速发展着,但其共享程度并不令人满意。在我国现有法律体系中海上交通信息制作人可受到多方面的保护,但深入分析、比较后可以发现,海上交通信息与其他智慧成果在法律特征上存在着重大区别,这些特点却没有反映在立法中。因此现有的法律保护存在着制度性的缺陷,阻碍着海上交通信息的共享。弥补这一立法不足,首先应当澄清海上交通信息的基本法律问题,并注意对各方利益的协调。

On Legal Predicament of Digitized Marine Traffic Information Share

The extent of sharing digitized marine traffic information in China is not being satisfactory.The China's present legal system provides many-sided protections for the people who made marine traffic information.But it is found by analysis that marine traffic information differs widely from other traditional intellectual property in legal characteristics,these features is not taken into account in legislation.There exists insufficiency in current legal provisions, which obstructs sharing marine traffic information.Fundamental legal issues of marine traffic information should be clarified first for compensating legislation shortage and also the benefits of different parties should be noticed.
