| 摘 要： | 本文结合国际航运及贸易实务,从法律和实践的多重角度,对《鹿特丹规则》关于承运人识别的法律推定进行研究和思考。《鹿特丹规则》关于承运人识别的法律推定,对船东可能带来严重不公平,中国政府和中国船东等应当充分注意其利弊并采取对策。

| Abstract: | Connected with the business of international shipping and trade,from more points of view of legal and practice,this article makes some study and considerations on identification of the carrier under the Rotterdam Rules.The presumptions about identification of the carrier under the Rotterdam Rules are very unfair to ship-owners.The government of China and the ship-owner of China should show great concern to its advantages and disadvantages,and should take some countermeasure. |
