| 摘 要： | 联通网通合并案使中国反垄断法是否规制以及如何规制特殊行业经营者集中行为等问题凸显出来.本文在界定特殊行业含义的基础上,对我国特殊行业经营者集中行为并没有当然获得反垄断法的豁免进行论述,认为特殊行业经营者集中行为在反垄断申报阶段应遵循平等适用原则,在反垄断审查阶段应遵循个案分析原则,提出反垄断执法机构在根据<反垄断法>的规定对特殊行业经营者集中行为进行审查时,亟需解决如何协调特殊行业中产业政策与竞争政策冲突,如何协调反垄断执法机构与产业主管机关的职权冲突等难题.
