修改宪法经济制度条款的若干问题

现行宪法经济条款自1982年以来已作了三次修改，但与迅猛发展的市场经济实践和理论创新相比，仍显相对滞后，有必要根据十六大精神作进一步修改。完善我国基本经济制度应改善和优化国有经济的主导地位、确认股份制经济的地位、明确支持私营经济发展。应平等保护不同所有制财产。在删除一些计划性、阶段性、政策性条款的同时，将完善宏观调控、加强经济监管、实行现代企业制度和健全经济法制，确定为经济工作基本指导方针。

Issues Regarding Modification of Article of Economy in the Constitution

Though the article of economy of the current Chinese constitution has been modified three times since its first enforcement in 1982, it remains improper compared with the rapid growth of pragmatic and theoretical initiatives of market economy. Part of the article has restricted relevant legislation and reform. Therefore, it becomes necessary to amend the article of economy in accordance with the spirit of the Sixteenth NPC . The fundamental economic system shall be perfected by improving and optimizing the leading role of state owned economy, validating the role of shareholding economy, supporting growth of private economy explicity way and protecting assets under different ownership systems. The improvement of macroeconomic direction, enforcement of economic regulation, implementation of modern enterprise system and advancement of rule of law in economy shall be established as the basic direction and guideline of economic work while a number of planned, phased and policy provisions shall be ruled out.
