铁路技术规章层级的探讨

中国铁路总公司、铁路局集团公司和站段3个管理层面的技术规章,构成了中国铁路技术规章体系,各层级合理分工的技术规章便于被正确理解和执行。目前铁路行业对总公司和铁路局集团公司2级技术规章的分工只有原则性的规定,为实现这2级技术规章层次清晰的目的,可进一步建立便于操作的划分标准。通过阐述铁路技术规章体系现状,针对存在的重复、抵触、跨局作业内容不一致、数量不均衡等问题,提出明确总公司专属技术规章制定权限、规范铁路局技术规章制定范围、建立重复和抵触判断标准等方面的建议。

Discussion on Layered System of Railway Technical Regulations

CHINA RAILWAY(CR),its subsidiary groups,stations and depots constitute the three layers of management in the country’s railway system of technical regulations.However,the system offers only the general principles guiding the work division for the top two layers – CR and its subsidiary groups.A clearer system requires more practice-oriented rules.The paper reviews the status quo of the technical regulation system and points out the potential concerns-regulation overlaps,conflicts of rules,as well as inconsistency among different groups.In conclusion,the paper offers suggestions,including the clarification of the limits of authority for the development of technical regulations at CR level,the definition of the scope for regulation drafting at group level,and the development of the approaches for regulation overlaps and conflicts.
