| 摘 要： | 电子合同的表现形式在法律上界定为书面形式，但是电子合同的表现形式和传统的书面形式是迥然不同的。我国的《电子签名法》对电子合同的表现形式作为书面形式的特征进行了初步界定，即有形性、原件性、保存性和真实性，但仍然需要进一步完善。本文认为，要对电子合同的书面形式进行界定，必然要对三个概念进行界定，即格式，识别和系统，这样方能推动电子合同的法律方面的完善。

| Abstract: | Although e-contract is totally different from the traditional one,it has been defined as written form in law.The Law of the People's Republic of China on E-signature has stated a basic definition about the characteristics of the written form of e-contract.In order to define the written form of the e-contract,the defintion of the following three concepts is quite necessary: format,identify and system.Thus,the improvement of the law related to the e-contrat can be promoted. |
