| 摘 要： | 海事责任的认定是我国海事部门的法定职责之一,在实践操作过程中,海损事故当事人对由于各自对事故的理解和判断的角度和方式各不相同,如果对海事机关就事故的认定不一致,可能会以诉讼的形式来保护自己的权利。本文试图通过对海事当局具体行政行为的分析,找到一个判断该行为是否具备行政诉讼法上的可诉性的方法,在具体海事认定过程中具有指导和参考作用。

| Abstract: | Confirmation responsibility for marine accident is one of the legal function of MSA. In the procedures of practice, the interested parties have different views on responsibility of maritime affairs because of different comprehension or different angle of view .if the interested parties disagree with the report of MSA ,maybe they are to uphold their right by lawsuit means .the paper try to analyze concrete behavior , want to find a means of evaluating prosecutability. It is helpful for concrete behavior. |
