对《1972年国际海上避碰规则》有关“不应妨碍”条款的理解和修改意见

《1972年国际海上避碰规则》(以下简称《规则》)的主要作用是指导船舶驾驶员、引航员如何采取避让行动以避免碰撞事故的发生,以及为船舶间发生碰撞事故后的责任划分提供法律依据,因此,如何正确理解和执行《规则》显得尤为重要。针对《规则》里面"驾驶和航行规则"中的存在容易引起误解的有关"不应妨碍"条款,提出个人的理解和修改意见,以利于《规则》的更加完善和正确实施。

Analysis And Suggestions about The Provision "Not to Impede "of The International Regulations for Preventing Collisions at Sea, 1972

The main function of the International Regulations for Preventing Collision at Sea,1972(COLREG) is to guide mariners or pilots how to take actions to avoid collisions between vessels., and to provide the legal basis for responsibility division after collisions. Therefore, it is very important to understand and implement this Regulations properly. Based on the facts that the provision "not to impede" of the Regulations are likely misunderstood in practice, this paper provides the author's personal understanding and suggestions about this provision of COLREG .,hope it can be advantageous in consummation and implementation of the Regulation.
