| 摘 要： | 针对我国《海商法》第268条规定的不明确性,通过分析我国相关法律法规的规定,论述了调整涉外海事关系中海事国际惯例适用顺序问题,指出在调整涉外海事关系中应依次适用我国缔结或者参加的国际条约、法律、行政法规、国际惯例、地方性法规、规章。在此基础之上,对我国《海商法》相关条款的修改与完善提出了建议。

| Abstract: | This article focus on the imprecise wording in Art.268 of CMC and,analyses relative laws and regulations in China,discusses the applicable order of maritime international usage in relation to mariner foreign-related matters.The paper points out the vertical application of international conventions,laws and administrative rules,regulations and international usage in relation to maritime foreign-related matters.On this basis,this paper presents the views to the reversion proposal of CMC. |
