船舶挂靠经营下登记船舶所有人连带责任问题研究

近年来,全国每年发生的海上交通事故中,相当一部分存在船舶挂靠经营法律关系,因船舶挂靠"挂而不管"、船舶安全状况差等问题引发了大量的法律纠纷。由于船舶挂靠经营中实际船舶所有人与登记船舶所有人之间责任承担无明确法律规定,加之法官个人对法律理解的不同,造成了司法实践中不同法院对同类案件的判决结果并不统一。文章从船舶挂靠的理论分析、司法审判实践以及法律规定等入手,并借鉴最高人民法院对车辆挂靠经营下道路交通事故责任认定的统一做法,进而提出船舶挂靠经营下登记船舶所有人应承担连带责任的立法建议。

A Study on Registered Ship-owner's Joint Liability in Ship Affiliation

In recent years, the maritime traffic accidents happen every year, quite a number of which involved in affiliated ships. Many legal disputes arise due to ship affiliated without due management and ship safety conditions Lack of explicit laws and regulations governing the ship affiliated responsibility between the ship-owner and registered owner, combined with the personal understanding of the law, court decisions on similar cases differ a lot. this paper analyzed theory and judicial practices, and law, etc., and draw lessons from the supreme people＇s court＇s explanation, and puts forward that the registered ship-owner shall bear joint liability under the affiliated business.
