交通事故责任认定规则的研究

为使交通事故责任认定工作更加科学与规范，以现行法规为主要依据，探讨了认定事故责任应遵循的基本程序和方法。提出了研究因果关系宜用“逆源法”；分析路权须考虑交通立法的根本宗旨，并符合更高层次的法律、法规以及自然法则；安全原则应作为确定事故责任取值大小的普遍依据。

Research on Responsibility Confirmation Rule for Traffic Accidents

To make the disposal work of traffic accidents more scientific and normal, the author discusses the procedure and means related with responsibility confirmaiton based on existing laws and regulat ions and some basic rules of responsibility confirmation are presented. The rese arch of causality must be from result to its cause. In analyzing traffic right and obligation one must think over legislative tenet and higher laws and natu ral regulations, and safety principle must act as general reference of responsibility confirmation.
