| 摘 要： | 由于钢材、水泥、砂石等主要建材价格波动很大,固定总价合同在履行中遇到了理论与实际的许多争议。通过案例,对固定总价合同的特点、风险、争议类型进行分析并提出防范对策,以期承、发包双方在签订此类合同时尽可能将风险范围估计充分,从而避免纠纷的发生。

| Abstract: | Many disputes have arisen due to wide fluctuations of the prices of steels,cements and gravels,etc.during performance of fixed lump sum contract.This paper,through a case,analyzes the characteristics,risks and disputes arising of fixed lump sum contract and presents counter-risk measures so that both parties of the contract assess the contract risks fully and thus prevent disputes from occurring. |
