Although liner conferences are traditionally assumed to possess effective monopoly power, such a view ignores many important aspects of their competitive environment. This article examines some of these neglected competitive features and shows how they may decisively influence conference pricing strategies.
In the analysis of linear shipping, the notion that conferences are effective monopolists lies at the root of many of the grievances of the conference system. It has also become an integral part of the conventional wisdom of shipping economies, to such an extent that the monopoly power of conferences is virtually regarded as a matter of established fact rather than what it really is-namely a postulated assumption open to testing and refutation.
It is the purpose of this paper to explore the competitive conditions of the industry in which liner conferences operate and to try and establish the extent and limitations of their market power. This paper, in two parts, reports on the perceptionof route competition via seaports in the European Communities Research Project wherein 72 interviews were held with freight forwarders throughout Europe (for the locations of the interviews see Part I, figure 1). This second part of the paper reports on the analysis of the openended tape-recorded responses of the interviewees to six separate sets of propositions they were shown; and there are extensive verbatim quotations. These quotations become longer as respondents warmed to the procedure. They tend to emphasize the increasing symbiosis of the land and sea operations within international transport. Among many vital topics of concern in a freight forwarder's life are costs and time. Not only does elapsed time equate with money expended, but also time limits equate with credit limits; any delay or unreliability results in sudden and enormous escalation of costs. Movement between countries in the mainland European Communities (EC) is more by truck than short-sea shipping. Customs are widely criticized as a cause of delays. The unfair (according to EC rules discrimination against UK forwarders by conferences tend to foster feeder services to mainland ports for British exports. But the opinion is that the power of conferences has declined markedly in recent years with the concomitant growth of independent lines. Freight forwarders may decline in numbers as their function changes. More capital is now required for computerizatio and credit bonds. There is a tendency to provide a more integrated service which would be symbolized by a growth of delivered price trading compared with free-on-board deliveries. 相似文献

This United States stands alone amongst the nations of the world in its attempt to unilaterally regulate transnational ocean linear services. The major reason for current US regularity policies with regard to scheduled ocean transportation lies in its fundamental distruct of any form of co-operation amongst competitors as demonstrated by its history of antitrust legislation. The linear industry, because of its unique technical and economic charectersitics has given rise to the establishment of ocean conferences—co ordinating sgreements between the operators of linear vessels. Whilst ocean conferences are permitted—even encouraged—by the their most diluted form, the so-called ‘open conferences. This Paper offers a critical review of Successive US regulatory practices in maritime transport. It is argued that these practices result in excess costs in US trades to the order of $1 billion annually, and that the linear industry‘s efficient functioning is seriously impaired by these rules-rules imposed by a government administration which fails to recognize that the linear industry‘s technical efficiency is of far greater importance than its market performance. 相似文献

This paper traces the evolution of Canadian liner shipping policy from its beginnings, at the time of the initial formation of shipping conferences, in the late nineteenth century, to its current form, as provided by the 1987 Shipping Conference Exemption Act. It is shown that evolution has been associated with a shift in policy orientation from an initial British-based position to a contemporary form that is distincly American in nature. The reasons for this shift are analysed and the similarities and differences between curent Canadian and U.S.A. legislation are identified. The paper shows that the adoption by Canada of an American-style policy became inevitable once the container revolution had physically integrated the transport systems of both nations. 相似文献

This paper examines the purposal by the British Shipper's Council (BSC) and the UK government to place a statutory limit, by means of a regulations implementing the EEC rules for competition, upon the proportion of a shipper's cudstom that may be demanded in a loyalty agreement with a liner conference.
The development of 70% loyalty is traced through the following the various drafts of the EEC competition rules for sea transport; the department of trade investigation which found freight rate disparities that were caused partially by the less competitive environment in the UK than on the Continent; and evidence given on 70% loyalty beforew the house of Lords Select Commitee on the European Communities.
By considering the precise proposals, as suggested by the BSC, and means of enforcing them, 70% loyalty is found to be eminently practicable. the short-term consequences of its introduction are unlikely to be great, considering the shippers' needs for a good quality service; but in time the additional competition fostered by a less-than-100% tie would cause radical changes; conferences would have to aopt limit-pricing and respond to competition loyalty ties might be restricted to service contracts with large shippers. These effects would be felt far more in the UK since the continental environment is in any case more competitive.

In Europe, ports are confronted with a closer integration in the maritime and shipping industries. The co-operation agreements can take several forms such as alliances and mergers among shipping lines, conferences, involvement of shipping companies in terminal management, and extending interests in inland transport of shipping companies. In this paper we give a brief overview of these different types of agreement and we examine the consequences of this evolution of the market structures in which ports and shipping companies have to operate. More specifically, attention goes to the competitive position of the port in this new environment. It is clear that the role of the port and the port authorities has to be redefined to guarantee that it remains a fully fledged player in this fast evolving integrated market. 相似文献
