This paper highlights sources of finance for Soviet shipping companies. These include the fund for the development of production, science and technology, the shipping company's foreign currency fund, loans and centralized sources. Modern management techniques are slowly but surely being introduced aslo in shipping management. Large sections of the industry practises strategic management at various levels in the firm. This paper outlines a method for deciding chartering strategies in the international bulk shipping industry. A well known risk/return model is tailored to transportation contracts in the shipping industry. The model delineates a set of optimally defined transportation contracts that may serve as a basis for the shipowner's strategic decisions. The strategies and elements of strategies suggested by the model have historically been practised by a number of successful shipowners. An important conclusion of the paper is that no second best problems exists and hence movement towarts the optimal solution is advocated even if such a solution cannot or will not be reached. Additionally, the paper provides an organized way of crafting, analysing and applying chartering strategies where the outcomes can be clearly defined and analysed based on well known statistical concepts and theories.  相似文献

In this paper we introduce, for the first time, a methodology from the most recent literature of finance to reveal the duration of shipping cycles and then show the benefit of the use of this information to make more successful shipping loans. This is so as banks are willing to finance, during boom periods, shipping loans for new buildings but by this way 'create' oversupply and thus depress the freight market by their own actions. The information about cycles, especially their forecasting, is mostly important as shipping loans are based on project financing/cash flow financing, which means that ship revenue is of utmost importance. The Rescaled Range Analysis is applied here to 379 monthly freight trips—made stationary—between 1971 and 2002 (July), due to Hurst 1 and elaborated and popularized by Mandelbrot 2. The most important effect, however, is that shipping freight series exhibit non-normality and long-run dependence rendering the use of random walk models such as GARCH (Generalized Autoregressive Conditional Heteroscedasticity) problematic. Thus an adequate literature review is carried out with criticism against the models used. The cycles have been calculated as equal to 4.5 years and 2.25 years. This is almost compatible with the most recent paper of Stopford 3. The Hurst exponent was found equal to 0.93, alternating over the periods examined (0.65, 0.73, 0.62, 0.59 and 0.55) and indicating long-term persistence but seriously away from normal/random walk domain. Most studies have said the same using the Jarque--Bera test for normality but provided no alternative.  相似文献

The identification of the responsible shipowner is essential for seafarers in order to claim payments and compensation in respect of their employment on board a ship. Often this may be difficult because of corporate arrangements and the many intermediaries traditionally involved in ship operation. The Maritime Labour Convention 2006 (MLC, 2006), adopted by the International Labour Conference (ILC) 94th (Maritime) Session in 2006, entered into force on August 2013; it significantly affects the shipowner’s responsibility in respect to seafarers’ employment. Taking into account the mentioned issue, the article examines the concept of “shipowner” under the MLC, 2006 and presents comparative analysis of the relevant national law implementing the MLC, 2006 in Denmark, Finland, Germany, Norway, and the United Kingdom.  相似文献

There is wide recognition that the process of climate change may be affecting the Arctic region at a faster pace than other regions. What is uncertain is the full impact of climate change on ice cover, and in particular whether there will be a significant decrease of summer ice from the current three months to a longer period and accompanied by navigation conditions suitable and safe for commercial shipping. New international navigation routes through the Canadian and Russian Arctic sectors could significantly reduce the length of sea voyages from Asia to North America and Europe. However, on the basis of what is known to date, there are significant differences of view as to the feasibility of international commercial navigation in the Northwest Passage.  相似文献

It has now been confirmed that some shipping companies could not meet the deadline set for complying with the ISM code for 1998, though available statistics show that most parties concerned have been ISM certified. What the legal consequences would be for such failure is the question on the minds of many people concerned. This paper sets out to deal with this question by answering, amongst other things, the following questions: (i) Would such a failure amount to unseaworthiness in the conventional international bills of lading law? (ii) Would such a failure provide valid defences to marine insurers for rejecting a related claim or prompt the establishment of a new pre-condition for purchasing insurance? (iii) Would such failure deprive a shipowner of the right to limit his liability under the international conventions concerned? (iv) Would such failure make the ships concerned more liable to detention at ports?  相似文献

The highly globalized and competitive nature of the shipping industry poses serious governance challenges. Recently, the use of voluntary measures, such as corporate social responsibility (CSR) initiatives, has been explored in terms of moving towards environmentally and socially responsible as well as safe shipping industry practices. Limited attention has been paid on the role of stakeholders such as consumers, employees, NGOs, and academia in pressuring the shipping industry towards greater environmental and social responsibility. Here, by applying stakeholder theory and drawing on examples of already materialized stakeholder actions and multi-stakeholder initiatives, we study the potential ways that stakeholders can promote CSR in the shipping industry: we explore the resource dependencies between stakeholders, the stakeholder influence strategies, and the importance of multi-stakeholder pressure. We show that stakeholders can gain more power by using indirect strategies such as working via and/or in alliances with NGOs, trade unions, banks and financers, and/or different national or international regulatory bodies, as well as with the industry itself. Our results reveal the potential of multi-stakeholder pressure and action to promote the adoption of CSR activities, support the transparency, legitimacy, and enforcement of the practices, as well as widen the scope and focus of CSR initiatives and practices by focusing on a broad range of social and environmental issues. Finally, stakeholder pressure can push towards improved regulations. The study suggests that increased attention needs to be paid on the multi-stakeholder demands, especially considering the accentuated importance of effective maritime governance in the future.  相似文献

A prominent feature of modern day piracy is the ransom that is demanded for the safe release of the ship, cargo and crew. The recent upsurge of this type of piracy, in areas of the world that are of strategic importance to the shipping industry, has created many challenges for shipowners, underwriters and the law relating to marine insurance. The aim of this paper is to examine how the marine insurance market is being affected by the threat of modern day piracy, and seeks to identify the options that are available for the recovery of a ransom payment by the shipowner. Moreover, this study aims to identify the legal issues that might prevent a shipowner from recovering a ransom payment under an insurance policy or from the other interests in a common adventure. The study establishes that a reasonably made ransom payment by the shipowner will amount to an extraordinary expense that is taken to minimise or avert a loss. Such an act can generally be recovered under the insurance policy as a sue and labour expense or from other interests in the common adventure as a general average expense. However, illegality, unseaworthiness and exemption clauses in a marine policy are identified as being legal issues that may prevent a shipowner from recovering the ransom payment. Some of these problems may be overcome if clauses are carefully drafted to specifically cater for modern day piracy in a marine insurance policy. Several inconsistencies may also be resolved by transferring the piracy peril to war risks cover. The shipowner’s duty is to respond to the changing circumstances, by ensuring that his vessel is sufficiently equipped and the crew is properly trained to resist a hijacking.  相似文献

Global economic development is facilitated by the commercial shipping industry. Shipping operations contribute to the growth of international trade activities, which heavily count on ships to carry cargoes from places of production to places of consumption. Despite its importance, there have been growing concerns about the environmental impacts caused by shipping activities in international trade. To balance environmental protection and productivity, many shipping firms have begun to adopt green shipping practices (GSPs) to improve their operations in a more environmentally friendly manner. GSP consists of six dimensions, namely, company policy and procedure (CPP), shipping documentation (SD), shipping equipment (SE), shipper cooperation (SC), shipping materials (SM), and shipping design and compliance (SDC). GSP is becoming an important aspect of shipping operations. It is timely for the shipping industry to evaluate firm capability in carrying out greening operations, that is, firms’ “greening” capability. Firm capability comprises two key elements: one is embedded in firms’ business routines or activities, and the other concerns firms’ ability in transforming inputs into outputs. GSPs can be considered as inputs while firm performance measures as outputs. This study uses an input/output approach to examine the greening capability (GC) of shipping firms. The results indicate that shipping firms are relatively weak in the practices of SC and SE, while the capability scores of SM, CPP, SDC, and SD are all close to 1, with an average score of 0.927, 0.920, 0.924, and 0.978, respectively. Academic and managerial significance of the findings are highlighted.  相似文献

Australia's merchant fleet underwent a delayed response to the trends responsible for the attrition of the OECD fleets over the past decades. A combination of political factors and the heritage of protectionism led to centrally-directed and government-sponsored programmes of modernization. Essentially, compliance with the federal government's shipping policy was achieved through the linkage of reform to tax incentives and to the management of change by tripartite shipowner, government and trade union committees.
