Abstract

In June 1987, the U.S. Supreme Court in Nollan v. California Coastal Commission held against the California Coastal Commission. Did this legal landmark signal the rise of a new, conservative jurisprudence of takings? And if yes, did that imply the demise of what had been accomplished by the so‐called quiet revolution in land use control that swept the country in the late 1960s and early 1970s? The complexities of this case cannot be understood apart from the historical evolution of the Coastal Commission's policies through the 1970s and 1980s, particularly its coastal access policies. Because of these policies the Coastal Commission, since its inception in 1972, has been subjected to all kinds of criticism, but at the same time has been widely praised for its balanced approach. These varying assessments of the role and record of the Commission also underly the conflicting viewpoints and arguments of Justices Scalia, who wrote for the majority in Nollan, and Brennan, who filed an extremely strong dissent. The resulting legal uncertainties, added to the political setbacks suffered from a lukewarm legislature and a hostile governor, forced the Commission to temper its assertive mission of maximizing coastal access, at least for the time being.  相似文献

Abstract

This article evaluates the performance of the California Coastal Commission's inclusionary housing program by examining: (1) the scope of the housing regulations, (2) initial permit decisions on residential projects, (3) the disposition of these permits overtime, and (4) the composition of completed projects and a best‐case projection of possible project completions. Using a case study of Southern California, factors affecting program success are discussed, including the effects of the various regulations, the availability of project subsidies, local government permit policies, and housing market fluctuations. The authors conclude that such state regulatory programs cannot be expected to succeed in urbanized coastal areas without incentives for developers and augmented state agency authority, superseding local land use controls.  相似文献

In Frank Capra's classic film It's a Wonderful Life, a despondent man takes a journey to see what life would have been like without him: the journey paints a bleak picture. In true Hollywood form, he is ultimately reassured of his impact even though his accomplishments were immeasurable. The film's protagonist, George Bailey, is the perfect metaphor for Connecticut's Coastal Management Program. The Program can measure quantifiable elements: the number of site plans reviewed, number of permits issued, acres of tidal wetlands restored. But coastal managers often lose sight of the accomplishments and ripple effects of management, possibly because accomplishments are taken for granted. Perhaps the true value of coastal management programs lies in that intangible, immeasurable idea of what coasts would be like without them.

This article takes readers on a George Bailey–esque journey by identifying the Connecticut Coastal Management Program's accomplishments since its adoption in 1980, reviewed in the context of several questions: What if the Program had never been adopted? What would public access look like? How many acres of tidal wetlands would be lost to development or Phragmites invasion? Hopefully, the results of the exercise will put coastal management into better context and highlight the successes.  相似文献

Data on hydrography, phyto- and zooplankton, obtained on a transect along the 0° meridian during the Winter Weddell Gyre Study, June 1992, revealed peculiarities of the early winter situation in the eastern Weddell Gyre. The vertical distribution and developmental stage composition of Rhincalanus gigas, Calanoides acutus, Calanus propinquus and krill, Euphausia superba larvae, were a good index for a general assessment of the seasonal condition of the plankton communities. There were five zones differing in seasonal situation: (1) The Polar Front and the southern ACC (not studied in detail), (2) The Weddell Front, (3) The Weddell Gyre interior, (4) The Maud Rise area, and (5) The Coastal Current zone. In the Weddell Front, the planktonic community resembled an autumnal situation with moderate phytoplankton biomass; the overwintering stock of copepods was not completely formed and the occurrence of calyptopes larvae of E. superba indicated that krill continued to reproduce until May. In the Weddell Gyre interior, a typical winter plankton community was found even before sea ice had formed. The specific hydrographic regime of the Maud Rise (governed by the mesoscale circulation over the seamount) support the late autumn conditions similar to the Weddell Front (but without early krill larvae). The plankton of the Coastal Current was a winter community. We conclude that in the eastern part of the Weddell Front (compared to the western part) seasonal development of both phytoplankton and herbivorous zooplankton is delayed in spring but prolonged in late autumn. Furthermore, it appears that the Weddell Sea ecosystem exhibits a much higher degree of spatial and temporal variability than thought before. This may have an impact on seasonal pattern of organic carbon transport from the pelagic realm to deeper water layers and to the sediment.  相似文献

Abstract

Evacuation inland ("horizontal evacuation") is the traditional method of saving life in areas forecast as the site of hurricane landfall. But “high confidence”; warning time is only 12 hours, while some coastal areas are now so densely populated that twice that time is required for evacuation. Coastal managers must therefore risk the ire of local citizens “unnecessarily”; evacuated early, and the associated risk that several false alarms will reduce citizen compliance, or the risk that evacuation will be too long delayed.

The alternative of vertical evacuation (going upstairs in hurricane‐proof buildings) is resisted by planners who are concerned that its risks are too high and that partial acceptance of the concept would vitiate compliance with the horizontal component. But in some areas there may no longer be a choice: prudent coastal managers must determine the potential need and capability for vertical evacuation in their areas. Effective integration of both vertical and horizontal evacuation will require development of new plans and policies.  相似文献

Abstract

This introductory piece traces the growth of knowledge and activity associated with visual resource management in general. A specific framework of questions regarding methods of coastal zone visual resource management is presented. The state‐of‐the‐art in methodological studies is listed for each question, and the methodological questions are related to the major articles with the special issue of the Coastal Zone Management Journal. Major legal federal statutes, state statutes, and court cases are reviewed in light of visual resource management in the coastal zone. The remaining articles within the special issue that deal with integration of VRM into decision‐making are then arrayed against a management framework. This framework includes regulatory situations for (1) public land management and planning, (2) public projects involving private lands, and (3) public regulation of private projects.  相似文献

Upwelling events driving ENACW (Eastern North Atlantic Coastal Water) into the Galician western coast rias had been considered typical spring–summer processes, according to the research developed in this area. However, they can also be observed in fall or winter under northerly winds blowing at shelf. Six different upwelling events were analyzed in the Ria of Pontevedra during the wet season (NDJF) from 2000 to 2005. These events were characterized by means of the zonal Ekman transport (Qx) at four control points in front of the western rias (locally known as Rias Baixas) and thermohaline variables measured at a fixed station in the main mouth of the Ria of Pontevedra. The duration of the upwelling events ranged from 27 days (during February and March 2002) to 69 days (during November–December 2004 and January 2005). Upwelling events studied in the Ria of Pontevedra from 2000 to 2005 showed the similarity in upwelling features during both seasons (similar wind forcing and upwelled water). Finally, Qx was correlated with the most representative atmospheric patterns in the Northern Hemisphere (EA, NAO, EA/WR, POL and SCA) from 1966 to 2005. The winter EA pattern has the most influence on Qx showing an annual evolution with a prevalence of the positive phase from 1976 on. This positive phase is directly correlated with a prevalence of positive values of Qx which are upwelling unfavorable in the Rias Baixas.  相似文献

Coastal areas are under increasing pressure driven by demands for coastal space, primarily though population growth, in migration and the need for space for socioeconomic activities. The pressures and associated changes to the coastal environment need to be managed to ensure long-term sustainability. South Africa has enacted an Integrated Coastal Management Act (ICM Act) to facilitate dedicated management of its coastal environment. The implementation has been met with a number of challenges, primarily relating to financial and human capacity constraints, particularly at the local government level. Given that the ICM Act devolves powers to local government, it is imperative that implementation challenges be addressed. This paper focuses on KwaZulu-Natal, one of four South African coastal regions, which is a renowned tourist destination and home to 11.1 million people (Statistics South Africa 2015 Statistics South Africa. 2015. Mid-Year Population Estimates. Statistical release P0302. Pretoria, South Africa: Statistics South Africa. [Google Scholar]). This paper considers the state of coastal management, as well as implementation challenges being experienced at a local governance level, and highlights ways to address these. Data were acquired through questionnaire surveys and semistructured interviews. The Drivers-Pressures-State-Impact-Response (DPSIR) framework was used to identify relevant ICM issues and concerns and develop potential actions for improving the implementation of coastal management activities and the ICM Act. In the assessment of the ICM governance and implementation to date, a key concern identified was a general lack of coastal management knowledge among officials. It was specifically identified that knowledgeable management and capacity-building required championing from the provincial government in order to more efficiently and effectively implement the objectives of the ICM Act through an improved understanding of the coastal environment, its functioning and management.  相似文献

Abstract

The Sefton Coast Management Scheme in northwest England uses an area‐based project to achieve coordinated land management. It is founded on the ‘'Heritage Coast'’ model pioneered by the Countryside Commission where a ‘"Project Officer”; is employed to promote the Scheme and translate the aims into practical achievement. The Sefton Coast is described and a summary of British coastal planning policy precedes a detailed analysis of the Scheme. The Scheme is assessed with reference to practical management work, its success in competition for scarce financial resources, and the involvement of volunteers. It is established that the Project Officer is crucial to the success of the Scheme and that area‐based management can best be achieved through the local government planning process. Coastal planning needs now to be reviewed at national level to develop a policy for the whole coast using the experience of projects such as the Sefton Coast Management Scheme.  相似文献

Abstract

The purpose of this article is to describe a program of agricultural land preservation in Carlsbad, California. This program focuses on agricultural subsidies and has been adopted and certified by the California State Coastal Commission and is scheduled for implementation on January 1, 1982.

This subsidy program is a variation of development rights transfer. Although no property rights are actually transferred, owners of land designated for agricultural use are subsidized by fees imposed on land designated for potential conversion to residential use. The Carlsbad program is placed into context by means of a brief review of similar proposals which attempt to preserve agricultural land in a fair and equitable manner.

The importance of agricultural land preservation is emphasized through discussions of urban development pressure, the significance of agriculture in the Carlsbad coastal zone, and the work of the California State Coastal Commission.  相似文献

Abstract

Competition for the use of our nation's shoreline has produced a thorough analysis of means to accommodate the increased demands of the public for access to the shore. The issue of public access in Rhode Island is considered at three levels. First, Rhode Island cases involving common law doctrines, such as the public trust, dedication, and so forth, are examined for their relevance. Second, the effect of the federal government in Rhode Island through the Coastal Zone Management Act and its amendments is studied. Finally, two types of state management programs are considered—a Commission for the Discovery of Rights of Way and the Coastal Resources Management Council.  相似文献

Abstract

This article examines the efforts of the California Coastal Commission to pursue simultaneously goals of environmental quality and affordable housing in the same state‐imposed regulatory program. The authors conclude that the Commission made substantial progress toward realizing both ends. However, the coastal body fell victim to its own successes, and housing was removed from its jurisdiction. As the Coastal Commission exercised its authority, opposition grew in strength and numbers. Key opponents included local government, which lost land‐use regulatory power to the Commission, the building industry, whose relationships with coastal localities were disrupted, and local property owners, whose land was restricted to uses other than the most profitable one.  相似文献

Abstract

A survey of coastal state legislation reveals several types of statutes affecting activities occurring in coastal regions: Coastal management statutes, wetland statutes, and shoreline statutes. Each coastal state has adopted methods to delineate coastal areas or features, whether an entire coastal zone, a limited feature such as wetlands, or shorelands. Boundary delineation is done according to linear measurements, political boundaries, roads and highways, vegetation, elevation, tidal flow, and other factors. An appendix is provided containing state statutory provisions relating to boundary‐delineation techniques.  相似文献

Abstract

Coastal zone management in Oregon is based on the state's general land‐use law. This body of law is designed to deal with population increase, urbanization, and preservation of agricultural land, as well as with other problems throughout the state. Early planning and policy recommendations for the coast were in the hands of a commission having predominantly local membership. This commission produced an extensive series of studies, policies, and recommendations which were assembled as a proposed management tool for natural resources. Staff of the commission was then absorbed into the state land‐management agency, which developed final goals and guidelines for compliance with the Coastal Zone Management Act. Adoption of the coastal goals in December 1976 has triggered deadlines for local government compliance within the coastal zone. The management program is now undergoing federal review.  相似文献
