The effects of marine cargo delays in law and commerce

With the development of door-to-door intermodal services and the advent of just-in-time supply systems, punctual delivery of cargoes is more than ever a priority both for shippers and for shipowners. This paper is about the incidence of delay in transportation, particularly in the marine mode, and its legal and commercial consequences.

The fundamental legal obligations of marine carriers have always included delivery with dispatch. Thus the law would seem to support the commercial expectations of shippers for reliable performance. The authors discuss the nature of these obligations, investigate their adequacy under modern conditions of trade and report on a survey of Canadian shippers and consignees.

The authors conclude that there appears to be a divergence in the toleration of delay, but that few of the Canadian companies suffering unacceptable delays received, or even sought, financial compensation and none of them planned to do more. The authors speculate about their reasons for absorbing the losses incurred through unacceptable delays. The evidence from the survey is that shippers, in spite of their dissatisfaction with the resolution or outcome of incidents of unacceptable delay, are loath to seek compensation through legal means, but instead prefer to resort to a range of commercial actions.

融合决策型网络安全技术在海上作战中的应用

融合决策型网络安全是近年来新兴的网络安全技术,其能够综合多种不同系统的安全态势信息,对复杂安全环境进行安全性分析和评价,从而克服传统单安全系统在多安全威胁环境下使用的局限性。随着信息技术和武器装备的不断发展,现代海战正向越来越智能化、越来越快速化的方向发展,舰队的通信网络往往需要面对复杂的安全环境和来自不同领域的安全威胁,而传统的预警手段难以应对如此复杂的情况。针对这种情况,本文对融合决策型网络安全技术在海上作战中的应用进行研究,并提出初步解决方案。     

中国海事:积极应对海上统一执法

在举国上下热议十八大报告中提出的建设海洋强国战略的兴奋心情尚未消退之际,国务院在提交十二届全国人大一次会议审议的《国务院机构改革和职能转变方案》中又提出重新组建国家海洋局,推进海上统一执法的方案,再一次引起广大人民群众的热议,也引起了外国特别是我国周边国家的高度关注。     

海难救助法律中的特别补偿制度

为寻求海难救助中救助人和被救助人利益关系的平衡,推动海上救助的顺利进行和健康发展,通过研究特别补偿制度以及船东互保协会特别补偿条款（SCOPIC）的产生背景和在实施中存在的问题,提出特别补偿制度在实践中存在很多现实问题,如明显倾向于保护救助人的利益以及“公平费率”问题、SCOPIC条款中救助人得到特别补偿的诉前担保十分困难,以及部分条款操作性不强等,认为海难救助法律中特别补偿制度需要进一步修改和完善。     

海上溢油污染应急处置科学决策的思考

从有效应对和处置海上溢油事故的目的出发,深入研究海上溢油的危害,提出对于船舶溢油处置这样一个由时间因素、空间因素、自然因素、船舶因素、环境因素、人员因素等众多因素所构成的多维复杂过程,应利用现代信息技术提高科学决策水平,构建综合溢油应急辅助决策平台,对各种应急资源和应急力量进行科学调度和协调指挥,实现溢油应急决策的科学化、系统化和智能化。最后,论述溢油应急辅助决策平台应具备的主要功能。     

海上多目标船物联网智能避碰辅助决策研究

船舶在海上航行的过程中,多船相遇会有不同的情况。本文将基于模拟退火的粒子群优化算法应用于海上多目标船舶智能避碰辅助决策中,建立船舶转向避碰幅度目标函数模型。最后利用仿真实验说明本文算法提高了全局的收敛速度、稳定性和通用性。     

The precautionary principle in maritime affairs

Since the 1980s, the precautionary principle has been drawing more and more international attention. This became particularly clear during the series of Conferences on the Protection of the North Sea, which addressed marine environmental protection, and initiated the application of the principle into maritime affairs. Although a unified concept of the precautionary principle is lacking, some typical formulations have been concluded in regional treaties and international documents, and components of the principle can be summarised (Part I and Part II). The precautionary principle has been adopted by international documents involving different fields of law of the sea, and been addressed by international courts and tribunals (Part III). While the precautionary principle is still not part of customary international law (Part IV), its increasing level of worldwide acceptance suggests that it will become a customary international law in the future.

《联合国海洋法公约》中有关海洋污染具体规定的简要分析 在《联合国海洋法公约》中,海洋环境保护问题是其内容构成中相当重要的部分.《公约》在正式条款之前就非常明确地指出"认识到有需要通过公约……保护和保全海洋环境",实际上这等于指明缔结公约的主要目的之一就是保护和保全海洋环境.《公约》中还对"海洋环境污染"做出了明确的定义:人类直接或间接把物质或能量引入海洋环境,其中包括河口港,以致造成或可能造成损害生物资源和海洋生物、危害人类健康、妨碍包括捕鱼和海洋的其它正当用途在内的各种海洋活动、损坏海水使用质量和减损环境优美等有害影响.而《公约》第192条在历史上第一次为各国规定了保护和保全海洋环境的一般义务,并进一步要求各国采取必要措施,防止、减少和控制任何来源造成的海洋环境污染.

生命起源于海洋,自古以来,能否征服海洋是显示国家力量的一个重要标志,而海上贸易是否发达则与繁荣,富庶紧密相连.占地球面积71%的海洋是人类和一切生命的摇篮,它蕴藏着无穷的生物、矿产资源,对世界各国特别是沿海国家的生存与发展息息相关.在世界各国、各地区经济日益相互依赖的形势下,加强各国之间和各国际组织之间的合作与协调对处理与海洋有关的问题至关重要.但是,近些年来由于受到来自人类活动的各种污染,海洋生态环境正在日趋恶化,海洋中的鱼类等海洋生物正在日益减少.这种状况不能不令人关注和担忧.     

Total losses and the peril of piracy in English law of marine insurance

Whereas the Marine Insurance Act 1906 provides substantial detail about total losses, very little is provided in relation to piracy in the said statute. The recent judgments in Masefield v Amlin by Steel J ([2010] 1Lloyd's Rep. IR 345) and then by the English Court of Appeal ([2011] EWCA Civ 24) have highlighted the difficulties associated with determining whether a seizure of the subject-matter of insurance, in this case cargo, by pirates, demanding a ransom, can give rise to a claim for a total loss. This is a very important matter which also raises issues of legality and public policy. This article examines the implications of this judgment against the backdrop of the English marine insurance definition of piracy and the intricacies of the law relating to constructive and actual total losses. The article concludes with the suggestion that possibly the marine insurance definition of piracy should tally with that in the domain of public international law, and further, that legislative intervention should be considered for the purpose of ascertaining the point in time whether and when seizure by pirates can constitute a total loss.

海洋环境下湿态混凝土力学性能时变规律研究

海洋环境下的湿态混凝土力学性能由于其所处环境变得更为复杂。掌握其力学性能随其饱和度变化的时变规律对混凝土结构设计和耐久性维护十分重要。该研究结合实际工况,通过理论分析和力学性能试验,对湿态混凝土轴心抗压强度、弹性模量和泊松比随其饱和度变化的时变规律进行了系统研究。研究结果表明:4种强度的混凝土单轴轴心抗压强度在浸泡28 d内变化趋势较多,到达28 d时较初始状态均下降,下降比例在7%～14%之间。4种强度混凝土的弹性模量和泊松比浸泡28 d内变化趋势较多,到达28 d时较初始状态均上升,弹性模量升高比例在5%～7%之间,泊松比升高比例在10.5%～23.5%之间。该研究对水运工程湿态混凝土力学性能研究具有积极的推动作用。
