The United States has a new national ocean policy that adopts ecosystem-based management (EBM) as its first principle for managing U.S. ocean spaces and marine resources. However, U.S. laws that govern the uses of ocean spaces present a challenging tangle of authorities and mandates that do not easily facilitate ecosystem-based policies. For over 30 years, U.S. marine fisheries management has been guided by eight Regional Fishery Management Councils. Working under the many laws that guide setting stewardship priorities for ocean ecosystems, councils provide the Federal Government with advice on fisheries harvest levels, fish habitat protections, and fishing community needs. Implementing EBM for any ocean ecosystem requires a careful examination of the laws and policy processes that affect human interaction with that ecosystem. This article explores the U.S. perspective on federal ecosystem-based fisheries management, its part in U.S. national ocean policy, and how fishery management councils might position themselves as both EBM policymakers and policy takers for ocean resource management.  相似文献

Fisheries management has been used to address declining fisheries and threats to livelihood and food security. Past research suggests that public support for fishery policies is a necessary component for sustaining the long-term success of fisheries management. This study predicted public support by examining fishers’ perspectives on co-management and fish catch since the establishment of marine protected areas (MPAs), a commonly employed fisheries management tool. Data were obtained from onsite surveys (n = 505) with fishers from three municipalities in Cebu, Philippines: Oslob, Santander, and Samboan. Structural path analyses revealed that beliefs about co-management and fish catch predicted support for fishery policies (R2 = 59%). Separate path analyses for each municipality showed that co-management had greater influence in predicting public support for fishery policies in Oslob and Santander. Fish catch was a better predictor for public support for fishery policies in Samboan. Results can help local governments, non-governmental organizations, and fishery managers to prioritize, plan, and improve fisheries management in municipal waters.  相似文献

The current regime of fisheries management and the prospects for attaining a more locally oriented, collaborative system of fisheries management in Diani-Chale, Kenya are examined. At present fisheries management in Diani-Chale is characterized by diminished government capacity for regulation, weakened local institutions, and little ability to exert control over the use of fisheries. Local level management requires the development and use of local institutions that can govern the use of fishery resources. The fish landing sites used by fishers and their associated fishing grounds were identified to be at the appropriate level for resolving fishery management issues. A more formal role for these entities, the clarification of fishing ground tenure and access rights, and support for the development and enforcement of local fishing rules can further local management. The socioeconomic condition of fishers, their fear of losing landing sites, and the continued perception of the imposition of a marine reserve pose barriers to initiatives seeking to further local level management.  相似文献

The dilemmas of competing priorities in a development situation are examined in terms of the impact of a highly commercial lobster fishery on a small-scale traditional fishery in the outer Hebrides, Scotland. United Kingdom Government policy in the Highlands and Islands of Scotland is aime at retaining population in marginal areas, and do this end a considerable capital investment has been made in buildings up the Hebridean lobster fishery. These policy priorities, however, are unaccompanied by any policy of resource management or conversation. The presence of a highly commercial fishery in the area thus results not only in a depletion of the lobster stocks but endangers the long-term benefits of the initial Government investment. The different work cycles ans gross earnings of the two fisheries are compared and suggestions are made as to alternative policies that would ensure the future viability of the newly developed regional fishery.  相似文献

In numerous fisheries management programs, managers have implemented measures to ensure that the benefits of the fishery accrue to those who are actively fishing. Although active participation measures are common in fisheries management, there has been limited research on these measures. This study highlights the variety of objectives that motivate the development of active participation measures and how they have been implemented. We examine the application of these measures in four case study fisheries management programs—the Alaska Halibut and Sablefish Individual Fishing Quota, the Pacific Coast Sablefish Permit Stacking, the Bering Sea and Aleutian Islands Crab Rationalization, and the Alaska State Limited Entry programs—and, based on the experiences in these programs, provide recommendations for instituting active participation measures in other management programs.  相似文献

This article examines the sociocultural, economic, and environmental causes of the decline of the artisanal fisheries in the rocky coast of Cape Creus (NW Mediterranean) over the past decades. The changes that have occurred over time have favored trawlers, purse-seiners, shellfish fisheries, and tourism activities, to the detriment of artisanal fisheries. This article shows that the establishment of a marine reserve in 1998 could not reverse the observed decline in the artisanal fisheries. This raises the necessity of implementing a fishery management plan integrated into a coastal management plan, which should accompany the habitat protection. These plans could assist in the maintenance and the sustainable development of the artisanal fishing sector in Cape Creus as well as in other Mediterranean coastal areas where artisanal fisheries are also declining.  相似文献

In this article we attempt to illustrate the potential benefits to Alaskan commercial fisheries expected from enhancements to the Alaska Ocean Observing System (AOOS) through changes in fishery management strategies. In particular we show how the use of improved AOOS data in research, stock assessment, and ultimately fisheries management has the potential to result in significant benefits in the Bering Sea and Gulf of Alaska groundfish and Kodiak king crab fisheries. We show through a case study approach that information such as might be provided by an enhanced AOOS could conceivably contribute over $600 million in additional annual revenue in Alaska's groundfish fishery. In addition we estimate that had the information from such a system been available in the 1970s and 1980s the Kodiak king crab stock collapse could have been avoided and $60 million in annual revenues generated. Benefit estimates (as measured by revenue increases) are based on the assumptions that when better data is delivered those data will be integrated into stock assessment models; when better data are integrated into the models the new data will actually improve the reliability of the models; and when the reliability of the models is improved predictions will be accepted by managers or industry members.  相似文献

Spiny lobster (Panulirus argus) represents one of the most lucrative fisheries in the State of Florida, and a majority of the catch is landed in the Florida Keys. Over the past three decades, the industry grew significantly, and by the end of the 1980s, state fishery managers agreed that the fishery was overextended. In 1991, the Florida Legislature passed the Spiny Lobster Trap Certificate Program (LTC), created to stabilize the industry by reducing the total number of traps while allowing fishers to transfer trap certificates in a market-based system akin to individual transferable quotas. Data from a survey study suggest that a majority of the respondents are dissatisfied with the LTC, which they view as transitory and unsustainable. The fishers' negative views are motivated by sociocultural changes in the fishing community. Managers need to consider modifications to the LTC and other such marketbased programs to minimize sociocultural impacts and retain small-scale fisher participation in such fisheries.  相似文献

Fishing community social networks function as channels for transfer of fishery knowledge, resources, and business transactions that help mitigate risks and shocks associated with altered access to fishery resources. Research on such networks in Alaska is limited despite their cultural importance and community reliance on fisheries. We contribute to scholarship of fishery social networks by assessing Alaska fishing community perspectives of challenges related to fisheries policy and management, and the existing social networks that aid in overcoming these challenges. Our findings show that the greatest challenges fishing communities face pertaining to fishery management are high costs of participating in catch share programs, restricted subsistence fishing activity due to decline in salmon, and complex regulations. Social networks exist for coping with these challenges; fishery information, and resources such as food, fuel and medicines are shared between communities. However, networks for accessing fishery support services are centralized in fewer larger communities and hubs such as Anchorage. Smaller and remote communities are the most compromised in this regard given the distance they must travel to access fishery support services. Leveraging social networks for sharing resources and improving fishery support services in smaller communities will increase their adaptive capacity and ability to maintain participation in Alaska fisheries.  相似文献

The South China Sea has attained global attention because of terraria disputes over oil, gas, fisheries and other resources in the sea area. Compared with the valuable natural resources, the underwater cultural heritage is not recognized or considered, but is an important legacy of many losses of vessels over centuries. Recently, the surrounding states in the South China Sea have taken measures to preserve underwater cultural heritage in their sea waters. However, the current complicated situation of the South China Sea intensifies the difficulties of protection of underwater cultural heritagein that area. There is an important and interesting potential issue of identification of ownership of underwater cultural heritage because of differences of legislation and claims to jurisdiction. Under the current information of legislation of some states in the South China Sea, it can be understood this issue cannot be avoid on the protection of underwater cultural heritage. This article discusses potential disputes over ownership of underwater cultural heritage in the South China Sea based on the different legislation of several states (China, Vietnam and Philippines) and proposes some possible suggestions for resolving the issue of ownership, rather than performing a primary research.  相似文献

Abstract

This paper deals with the difficulties of implementing legislation in non‐Western social and cultural contexts. The author presents an abbreviated case study of Alaska's effort to increase the economic returns of resident fishermen by restricting entry into state‐controlled fisheries. This paper examines how the implicit objectives of Alaska's Limited Entry Act of 1973 were effectively obstructed by the regulatory policy and by the implementation process. The paper focuses on the impact of this policy on Native Americans of Bristol Bay, Alaska, the site of the largest commercial fishery in Alaska and the world's largest salmon runs. Presented are some of the reasons several hundred natives were ultimately excluded from participating in the local commercial fishery.  相似文献

Harmful algal blooms (HABs) may be increasing in frequency and intensity worldwide. Coastal economies suffer significant income losses when fisheries or beaches are closed to protect human health and subsistence fishing communities are at risk. Despite these hardships, managers must often conservatively close harvests across a wide area or for long periods, because they lack scientific information that would allow them to predict HAB events. The outer coast of Washington State has experienced several closures of the razor clam (Siliqua patula) fishery starting in 1991, due to domoic acid (DA) contamination caused by toxic blooms of the diatom Pseudo-nitzschia. Improved science-based management was needed to minimize the impact of DA on this fishery and the coastal communities that relied on it for income, tourism, and subsistence. The Olympic Region Harmful Algal Bloom (ORHAB) Partnership, comprised of state and tribal managers, scientists, and local stakeholders, evolved in response to this need; it has been successful in its mission. Here we examine ORHAB through the lens of the Institutional Analysis and Development framework, in order to identify key factors contributing to its success. The relevance of our findings for other ORHAB-like institutions in the Pacific Northwest and elsewhere is discussed.  相似文献

The stocks of principal groundfish species off New England have collapsed, creating economic hardship and dislocation in fishing communities from Rhode Island to Maine. In this article we analyze the causes of this collapse using the ?ratchet effect? described by Ludwig, Hilborn, and Walters (1993) as a framework. According to Ludwig, Hilborn, and Walters, powerful economic and political interests drive fisheries to overcapitalize and overexploit despite scientific evidence that stocks are declining. When the fishery is no longer economically viable, governments provide financial assistance to minimize economic hardship. When stocks increase there is another rush to invest, and the cycle repeats itself. The history of groundfish management in New England conforms well to this model. Optimism among fishers and government over U.S. control of this fishery in 1977 stimulated successive rounds of investment that built up excessive fishing capacity despite warnings from scientists that stocks were becoming weaker. Management regimes designed by the New England Fishery Management Council were ineffective in constraining fishing effort. Collapse of the stocks has led to severe restrictions on fishing and to government assistance. We suggest that the integration of science, management, and harvesting sectors through ecosystem-based management offers the best means of avoiding similar situations in the future.  相似文献

The Dungeness crab (Cancer magister) fishery, economically robust in California while other fisheries are depressed, is under pressure to develop new management tools. The California Legislature and responsible state agencies have responded to each new crisis in the fishery with revised management regulations that are unwieldy in adapting to changing conditions. Some fishermen are displaced, while others benefit. This then leads to the next set of challenges and reactions. The differing economic needs of processors and fishermen, large and smaller producers, and northern and southern fishermen, plus the agendas of influential nongovernmental organizations, produce advocacies for conflicting management options, hindering progress toward resolution. The Legislature wants guidance from the fishery, but the fishery does not speak with one voice. Alternative dispute resolution can help these diverse but interdependent interests move toward agreement on new management tools. The principles of adaptive management—gathering information, setting goals, predicting outcomes, monitoring and evaluating results toward obtaining such outcomes, then reviewing what worked and what failed—can lead to more economically and socially optimal outcomes.  相似文献

Abstract

Corals and coral communities provide substantial societal benefits by virtue of their recreational and esthetic appeal, the habitat provided for commercially harvested fish and shellfish, the structural foundation provided for productive coastal ecosystems, and the market value of harvested coral specimens. Coral resources are subject to adverse effects from pollution, dredging, specimen collecting, anchor damage, commercial fishing, overharvesting, and activities related to offshore petroleum development. Management programs which protect coral resources in the United States comprise a patchwork of separate federal and state programs. They attempt to adapt broad regulatory authorities for parks, fisheries, offshore mineral resources, and other subjects for the purpose of coral conservation. These programs embody species‐specific, area‐specific, and generic approaches to coral management. This paper traces the evolution of U.S. coral management programs and comments on their respective strengths and weaknesses. Alternative approaches for strengthening management systems could include new coordinating committees, legislation, memoranda of agreement between involved agencies, and others.  相似文献

A step-wise approach to implementing ecosystem-based fishery management (EBFM) offers both a tractable policy opportunity and feasible set of scientific responsibilities in ongoing efforts to incorporate ecosystem dynamics into fisheries management. This case study of oysters in the Chesapeake takes a regional approach and utilizes a fishery species that is a popular menu item, an important habitat for other fish species, and a cultural touchstone in the area. From grounding in ecosystem service policy goals and a survey of stakeholders from across industry, management, science, and community groups, we developed eight indicators that are meant to serve as a first-order check for EBFM. We evaluated these indicators based on data availability, spatial coverage of the whole region, and relevance to ecosystem service goals. Spatial integration of indicators addressing chemical, biological, social, and economic factors, allows identification of localities within the region that require more attention, either by scientists or policymakers, in order to meet EBFM goals.  相似文献

The International Tribunal for the Law of the Sea (ITLOS) was established by the 1982 United Nations Convention on the Law of the Sea as a body to settle disputes between States Parties to the Convention regarding the interpretation or application of the Convention s provisions, including provisions concerning the exercise of the powers of States over shipping and the discharge by states of their responsibilities and obligations in relation to ships.ITLOS is competent to deal with disputes in which a State is alleged to have wrongly interfered with or otherwise restrained the operation of a vessel when it is in a port of the State or within the territorial sea or exclusive economic zone of the State.In its previous judgments, ITLOS has provided clarifications of some important areas of the law of the sea concerning the operation and regulation of shipping by flag States and other states.ITLOS plays a key role in the regime of the Law of the Sea Convention relating to the prompt release of ships and their crews that are arrested or detained in a foreign port.ITLOS also has the possibility to serve as ajudicial organ for the settlement of disputes under other maritime agreements and contracts, if the parties to the agreements or contracts agree to confer jurisdiction on it.There are many advantages to be gained by States and shipping operators from using ITLOS as the body for the settlement of disputes under agreements.
