沿海发达地区村庄用地构成与用地控制——以青岛胶南市为例

通过对青岛胶南市若干村庄进行的调研,运用科学的技术方法对村庄用地构成进行了统计、整理与分析,从中梳理出村庄规模与宅基地、道路用地、巷路用地的相关性。在对用地构成分析的基础上,提出对村庄用地进行规模控制的概念,从而为控制、引导村庄建设规模提供更科学、合理的研究方法。     

论《海上交通事故调查报告书》的证据效力

海事调查报告,是海事管理机构对负有行政责任的事故当事人进行行政处罚的重要依据。至于海事调查报告在司法审判过程中的法律效力如何,无论是立法者还是学者都尚无定论。这既不利于海事调查报告法律地位的确定,又给我国的海事司法审判带来一定的障碍：文中从一则利用AIS（船舶自动识别系统）信息查找肇事船舶的案例出发,分析论述海事调查报告在海事审判中独特的证据效力,以期对上述问题的解决提供参考。     

海洋中晕船问题的案例研究(英文)

Motion sickness is one of the main reasons why travelling by sea becomes a bad memory for a number of people, mainly due to a nauseating symptom. The aim of this paper is to characterize a condition called seasickness that has affected many people from a mathematical and psychological point of view. Based on the mathematical characterization, an existing model will be reviewed and described. In the psychological aspects, a statistical study of two hundred and thirteen people was performed in order to provide a comprehensive view of the different psychological factors affecting the passengers. Motion sickness also impacts onboard safety, as it reduces the effectiveness and the operating capability of the crew when responding to hazardous situations.     

The international regime of compensation for oil pollution damage and the policy of the International Oil Pollution Compensation Funds as to the admissibility of claims

This article describes the international regime governing compensation for oil pollution damage from ships. It sets out the main features of the relevant international Conventions, the Civil Liability Conventions and the Fund Conventions, and explains the operations of the International Oil Pollution Compensation Funds, their structure and financing. The procedure for settlement of compensation of claims is outlined and a summary is made of the criteria for the admissibility of claims for compensation. The ongoing review of the international compensation regime is described.

The consequences of “culture’s consequences”: A critical approach to culture as collective programming applied to cross-cultural crews

In this article, it is claimed that research on cross-cultural crews is dominated by one specific understanding of the concept of culture, which is static, evenly distributed and context-independent. Such a conception of culture may bring some basic order while facing an unknown culture, but it may also have unintentional outcomes. It may lead to a deterministic view of other cultures, thereby reinforcing prejudices and underestimating other forms of differences; it risks blinding the participants of the specific context of a given communicative situation. The article opens with a critical review of the theory of Geert Hofstede, the most renowned representative of this theoretical approach. The practical consequences of using such a concept of culture is then analysed by means of a critical review of an article applying Hofstede to cross-cultural crews in seafaring. Finally, alternative views on culture are presented. The aim of the article is, rather than to promote any specific theory, to reflect about diverse perspectives of cultural sense-making in crosscultural encounters.

1403年,朱棣发动政变,火烧南京皇殿后登基。登基之后,明成祖朱棣便责令开始大造海战船队,并派郑和率军下西洋,从此中国在世界航海史上写下了浓墨重彩的一笔。郑和初次下西洋时的船舶建造和检验技术,在当时已领先国际,龙江宝船厂、太仓苏州府船厂、三卫船厂也因主要承担这些海船的建造而名垂青史。

Universal jurisdiction as obligation to prosecute or extradite

Before searching for new legal solutions to manage maritime piracy problems, especially those related to jurisdiction, it is essential to examine and analyse the existing international legal framework to determine whether current international legal instruments are already appropriate to face off this threat. One such principle is the “Aut dedere aut iudicare” principle, which has been also codified into SUA Convention, at art. 6 par. 4. This obligation comes from an international treaty, so it cannot be disregarded by any state (short of becoming susceptible to international liability), neither can it be amended by a national law. If a state party has inadequate law resources to establish its jurisdiction, or if unable or unwilling to prosecute the pirate, then such state party has no choice but extradite the pirate. If we consider the above principle as a conventional obligation, then it should be limited only to state parties, and it should be applied only under conditions stated by SUA Convention. Instead, if we consider it as a customary law principle, because piracy—as crimen iuris gentium—offends international community as a whole, then such principle shall be binding without any limit or condition.

基于提高船舶破损稳性的管路优化设计

舱内敞口管路穿过水密舱壁或甲板时,如果管路因意外破损,将破坏舱壁或甲板的水密完整性,从而削弱船舶的破损稳性。通过对该管路路径进行优化,使其在布置时经过船舶的破损安全区域,或设置隔离阀将敞口管路变为闭口管路,可有效阻止船舶破损工况下浸水区域的海水经过破损管路进入完整舱室,保证完整舱室的水密性,进而提高船舶的破损稳性。
