On 3 May 2003,a COSCO cargo carrier “Fu Shan Hai“ collided with a Polish containership in the sea east of Denmark and sank later. It was reported that the insurance premium for M/V “Fu Shan Hai“ is as high as US$30m. It is the ever large claim case in the marine insurance history of the People‘s Insurance Company of China (PICC). Though PICC launched its emergent compensation procedure and paid 70m yuan (RMB) to COSCO, this is far from enough to fill the hole. The “Fu Shan Hai“ accident gave a hard strike on the marine insurance market, worsening the difficult situation of marine insurance in China. 目前我国各大保险公司均采用中国人民保险公司1981年制订的《海洋运输货物保险条款》来承保海运货物保险。该条款分为平安险、水渍险及一切险三种险别。一切险除包括平安险和水渍险的各项责任外,还负责被保险货物在运输途中由于外来原因所致的全部或部分损失。然而,一切险下保险人的保险责任范围规定的并不十分明确,容易引起争议。当保险合同条款规定的不明确而发生争执时,根据我国保险法和合同法的规定以及国际惯例,应当作有利于被保险人的解释。中国人民保险公司海洋运输货物保险条款一切险中保险人的保险责任解释为仅指承保平安险、水渍险及11种普通附加险的观点是不正确的,应当予以纠正,以维护被保险人的合法权利。 相似文献
