| 摘 要： | 自2001年加入世界贸易组织至今,中国一共参与争端解决29起,其中作为申诉方参与了8起,作为被诉方参与了21起。虽然这些数字与其它几个主要贸易大国相比并不显得突出,但是像知识产权案(DS362)、出版物及视听制品案(DS363)、限制出口案(DS394、DS395、DS398)、银联案(DS413)以及反倾销与反补贴调查案(DS379)等争端涉及我国一些重要的经济领域和产业政策,有些还关系到我国立法水平的提高,对中国的法治建设和经济发展都具有较为深远的影响。从争端的起因看,这其中既有我们自身的原因,也有外部原因;从解决的结果看,中国不仅检视了自己的法律、法规是否符合世贸组织的规则,同时也积累了多边贸易体制下的争端解决经验。这些经历对于正在将自己融入全球经济一体化的中国而言是必不可少的。
