内河交通安全视角下农用船舶监管的法律思考

我国用于农业生产、满足农民生活需要的非经营性船舶分布广泛、数量庞大。由于现行国家层级的立法存在缺位,地方层级的立法差异过大,管理部门职责不清,难以形成有效地监管合力,为水上交通安全埋下了重大隐患。为了更好地管理农用船舶,文中提出通过农用船舶概念法律化、管理主体明确化、技术标准规范化、航行区域特定化、安全管理地方化的建议,以保证法律之间的协调,促进农用船舶监管秩序的形成。

Consideration on the law of agricultural vessel supervision in the view of inland water transport safety

In China,there are a large number of non-commercial ships which are widely used in agricultural production and meet the needs of farmers.Due to the current absence of legislation at the national level,the significant difference of legislation at the local level,and the unclear responsibilities of the management departments,it is difficult to develop an effective regulatory force,which has laid a major hidden danger for water traffic safety.In order to better manage agricultural ships,the paper puts forward suggestions,including legalizing agricultural ships,clarifying management subjects,normalizing technical standards,specifying navigation areas,and localizing safety management,so as to ensure the coordination between laws and promote the formation of the supervision order of agricultural ships.
