Consideration on the legal issues of initiating administrative penalty related to water transport accident

It is the statutory duty of the maritime administration to punish the party responsible for the water traffic accident.However,there is no clear definition as to when to start the relevant penalty process.Such a problem is resulted from the inconsistency on the scope of marine investigation between different regulatory documents.Based on the methods of article comparison,legal interpretation and effect evaluation,it can be concluded that carrying out punishment after completing the determination of liability is conducive to clarifying the time for start-up,to optimizing management costs and to maintaining the credibility of MSA.
