法律英语术语误译的对策研究

随着中国法制化和对外交往的进程的加快,我国加快了向国际发达国家学习的步伐,这其中就包括法律的学习和借鉴。目前我国的法律制度正在与国际接轨,尤其是近些年来,随着我国对外法律文化交流的增多,我国每年都有大量的法律文献被译成外文,同时也有大量外国的法律文献被译成中文,可谓硕果累累,成绩喜人,但其中也存在不少问题。翻译法律文献,最重要的是法律术语的翻译,然而纵观中国目前的法律英语的翻译还存在很多问题,本文就试图以一些实例来分析法律术语的误译及其原因,并从中找出一定的避免误译的对策。

Countermeasure Study on the Incorrect Translation of English Legal Terms

With the rapid development of Chinese legal system and increasing foreign exchanges, China is marching forward to learn form foreign countries, including their laws. Presently, Chinese legal system is integrating with international legal systems. Each year a lot of Chinese legal documents are translated into foreign languages and vice versa. On the one hand, these achievements are fruitful and encouraging; on the other hand, there are many flaws with the translation. As for translation of legal documents, the core is the translation of legal documents. This paper tries to discover some countermeasures to avoid incorrect translation by analyzing some examples of incorrect translations of legal terms.
