| 摘 要： | 劳务派遣合同纠纷中,船员中介机构使得船舶优先权的实施复杂化。本文从船舶优先权法定担保物权的性质出发,基于原存的海事请求权和保障海事请求权优先受偿的考量,对劳务合同纠纷案中船舶优先权权利主体进行分析,以保障船舶优先权原债权人的权利。 |

| Abstract: | The intermediary organ makes the maritime lien enforcement more complicated on the dispute of labor dispatching contract. This paper, based on the consideration of maritime claims and safeguarding the maritime claims＇ preferred payments, analyses the Subject of Right of Maritime Lien on the Dispute in Labor Dispatching Contract for the purpose of protection the original creditor＇s right. |
