知识产权海关保护的两种模式分析

近年来,随着国际贸易的迅速发展,侵犯他人知识产权的非法货物的国际贸易数量也呈上升趋势。为遏制国际贸易领域的侵权盗版活动进一步恶化的势头,世界各国在加强对知识产权的立法和司法保护的同时,也把知识产权保护的重点转向行政保护、特别是海关的边境保护方面。我国为此颁布实施了《中华人民共和国知识产权海关保护条例》。该条例明确了知识产权海关保护的两种模式,本文主要论述两种模式的差异,提倡知识产权权利人采用主动保护模式,积极维护自己的权益。

Analysis on the Two Modes of Customs Protection of Intellectual Property Right

In recent years,with the rapid development of international trade,the trade of illegal cargo infringing upon others intellectual property right is also on the increase.To hold back the deterioration of the embezzlement in the area of international trade,countries of the whole world are focusing on the leading points of administrative protection,especially on the boarder protection of customs while strengthening the legislation and jurisdiction protection of intellectual property right. Hence, China implemented the "Terms on the Customs Protection of Intellectual Property Rights, PRC",stipulating the two modes of protection.This article exerts analysis on the difference of the two modes and advocates the active mode of protection to safeguard the interest of the owner.
