| 摘 要： | 《1972年国际海上避碰规则》准许在必要时背离避碰规则的规定来避免紧迫危险。通过对避碰规则条款归类、分析,可以被背离的避碰规则条款必须是强制性的、不附例外条件的、针对性的具体避碰规定。具体而言,只有狭水道条款中的右行规则和对遇局面中的右转规则才存在背离的可能。

| Abstract: | In the COLREG 72 some anti-collision rules may be departed from in case of necessity in order to avoid emergent dangers.The analysis made in this paper reveals that only these compulsory,situation-specific rules without provisions can be departed from,i.e.the "keep to starboard rule" in the Narrow Channel Rule and the "starboard turn rule" in the Head-on Situation Rule can be departed from. |
