论司法资源配置与司法公正

司法程序公正得以保障的物质基础是充沛的司法资源.随着社会现代化程度的不断发展,人与人之间的关系越来越疏远,诉讼成为解决争端的主要方法,诉讼率日益增高.当诉讼爆炸与司法资源稀缺的矛盾突兀的呈现时,法律制度必须成为"一种配给制度".然而,法律资源配置的不充分、不平衡,使司法审判人员拥有不同的法律资源,当事人不能平等地享有法律资源,各方参与者徒具形式上的平等参与机会,在实质上却不具有平等的参与能力和参与效果.在这一过程中,弱势群体因自身或社会的原因失语于司法资源配置的利益博弈,往往以被排挤者的面孔出现在我们周遭,并以体制外的诉求表达途径来拷问这个市场的合理性.因此,合理的配置有限的司法资源应当成为司法公正的机制保障.

On the Allocation of Judicial Resources and Judicial Justice

The judicial process justice is based on enough judicial resources.With the development of modernization,the relations among people become more indifferent and the litigation becomes the main method of resolving disputes.When the litigation explosion and scarce judicial resources show an unexpected contradiction,the legal system should become a "allocation system."However,the legal allocation of resources is insufficient and unbalanced.Justice staff has more legal resources while the parties to the lawsuit can't share enough legal resources,resulting in unequal participation ability and unequal results.In this process,the vulnerable groups of society due to their own or social reasons are out of this Justice Game.Therefore,the rational allocation of limited judicial resources should be a security system of judicial justice.
