海事行政执法中"不作为"行为的分析

海事管理机构行政不作为现象局部存在,这与依法行政要求尚有一定的距离,与社会对海事管理机构职能履行要求有一定的差距。本文从海事行政不作为的现象、原因、危害等方面进行综合分析,提出减少或杜绝海事行政不作为的对策。建议从海事立法、海事执法、海事执法监督各个方面各个环节查找存在的问题,切实在海事行政执法实践中做到“不乱作为”和“有效作为”。

Analysis of "No Action Taken" in maritime law enforcement

Administrative nonfeasance has become popular in some maritime administrative agencies,which doesn't meet the requirements of administration by law and the expectations of the society on maritime administrative agencies with regard to administrative responsibilities by law.This paper firstly examines the phenomena,its factors,causes,as well as its consequences of administrative nonfeasance in maritime law enforcement.Then it puts forward some countermeasures and suggestions that may help overcome administrative nonfeasance and fulfill the requirements of maritime administration by law.By conclusion,efforts should be attached to comprehensively solving the problems during the process of maritime law making,enforcement and monitoring and evaluation,thus to provide a framework for accountable and transparent maritime law enforcement.
