摘    要:介绍了“险情+避让”二元事故认定模式的理论依据,并着重从实体和程序2方面阐述二元事故认定模式。此模式对公安机关交通管理部门事故认定自由裁量权有所制约;将有助于交通事故认定统一化、规范化。

Abstract:Through introducing the theoretical foundation, the paper focuses on the substance and procedure of the dualistic pattern ofEmergency & Anti-Collisionin traffic accident identification.The pattern aims at strengthening the control on the free judgment in traffic accident identification of traffic administration department,which will help unification and standardization of traffic accident identification.
