社会治理视阈下的民族习惯法

社会治理要求形成政府引导、社会多元主体共同参与的治理模式,这必然需要多种社会规范共同发挥作用,民族习惯法就是这样一种社会规范体系。习惯法在民族地区社会治理中具有相当程度的价值正当性和实践合理性。民族习惯法在社会治理中具有参与协商、民意认同、灵活变通、成本低廉等优势,但在社会治理中也会产生负面的影响,因此,必须引导习惯法自身与国家治理现代化的进程相适应。

The Research on Chinese Customary Law of Ethnic Minorities under the Perspective of Social Governance

Social governance requires a new management system including the government guidance and social participation of multiple subj ect.The construction of this system will need a variety of social norms to play a role together,and the national customary law is such a kind of social norm system.In the process of social governance,the customary law possesses considerable value legiti-macy and practical rationality in ethnic regions.National customary law has its unique advantages in the social governance,for instance,it can in the negotiation,reach public identity,realize flexible adaptation,and have low cost in solving problems.But in the meanwhile,the customary law has a negative impact to some extent,therefore,we must guide the customary law itself to adapt to the modernization of national governance.
