前期物业服务合同刍议

摘    要:物业服务合同是现代物业管理法律关系中最为核心的内容.前期物业服务合同与普通物业服务合同前后相续,相互衔接,两者在合同的签订时间、主体以及生效期间都有所不同.文章分别从债权的物权化、涉他合同、合同承受的角度分析房地产开发商、物业管理企业和业主的三方法律关系,以期更好地理解前期物业服务合同.

Abstract:Estate service contract is key to the legal relationship established by estate management. The preliminary estate service contract and a standard estate service contract combine with each other in estate managemerit. They are different in the time of signing contract, the parties of contract, and the period of contract and so on. In order to well comprehend this kind of contract, the paper analyzes the tri-party relationship between estate agent, estate management company and owner from three different angles of view.
